TRUSTEE'S NOTICE OF SALE
WHEREAS, Rejoice O. Morgan, by Deed of Trust dated January 20, 2022, and recorded in the Register's Office of Benton County, Tennessee, in Record Book 371, Page 235, conveyed to W. Kent Jones, Trustee, and subsequently to John W. Whitworth, by instrument of record in Record Book 428, Page 1230, in the Register’s Office of Benton County, Tennessee, the hereinafter described real estate to secure the payment of a certain installment note and any renewals thereof; and
WHEREAS, default has been made in the payment of the indebtedness and the holder of the note has declared the entire amount due and payable as provided in the Deed of Trust. The Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof and the public is hereby notified that the undersigned Trustee will sell hereinafter described real estate at public auction to the highest and best bidder, for cash in hand, at the North door of the Courthouse in the Town of Camden, Tennessee, at 10:00 a.m. on December 15, 2025. Said property to be sold in bar of the equity of redemption and subject to the liens of all special assessments against it.
The real estate to be sold is located in Benton County, Tennessee, and more particularly described as follows:

BEGINNING at a point in the center of Cedar Grove Road, at the southwest corner of this tract (with State Plane NAD 83 Coordinates of N: 671,339.92 & E: 1,363,862.83), about 614 feet South of intersection with Hicks Road; thence with center of Cedar Grove Road for 309.42 feet in 3 calls as follows: North 43 degrees, 05 minutes, 15 seconds West, 122.07 feet; North 50 degrees, 28 minutes, 33 seconds West, 90.48 feet; and North 52 degrees, 50 minutes, 39 seconds West, 126.87 feet to a point in same; thence leaving road with Jesse Berry (Parcel 017.00, Map 046) for 2 calls: North 82 degrees, 27 minutes, 06 seconds East, 37.64 feet to an iron pin found with cap RLS #384 (Marshall Turner) and continuing this bearing with a fence for an additional 532.37 feet to an iron pin set (with cap #898); and North 02 degrees, 23 minutes, 06 seconds East, 504.60 feet to an iron pin set in the old original tract north fence boundary; thence with old fence and Parcel 014.01 for 2 calls: North 86 degrees, 06 minutes, 38 seconds East, 178.41 feet; and North 89 degrees, 02 minutes, 20 seconds East, 161.64 feet to a 14-inch cherry fence corner at northeast of this and the original tract corner; thence with old fence on original east boundary for 6 calls, first with Gary Berry: South 01 degree, 00 minutes, 34 seconds East, 141.14 feet to 12-inch red oak; thence with Parker (Paracel 032, Map 046), South 02 degrees, 32 minutes, 14 seconds West, 204.02 feet to 42-inch red oak; South 07 degrees, 12 minutes, 57 seconds West, 196.43 feet to 24-inch poplar; South 17 degrees, 35 minutes, 50 seconds West, 81.99 feet to 8-inch sourwood; South 02 degrees, 31 minutes, 22 seconds West, 74.92 feet to an x-tie post; and South 00 degrees, 25 minutes, 16 seconds West, 341.38 feet in iron pin found with Cullivan RLS cap in fence at the southeast corner of this tract; thence with Joyner (Parcel 017.04, Map 046), North 84 degrees, 13 minutes, 22 seconds West, 140.87 feet to a crosstie fence corner at the southeast of Axley (Parcel 017.05); thence around said Axley, in 4 calls: North 16 degrees, 30 minutes, 30 seconds West, 320.56 feet to a crosstie fence corner; South 79 degrees, 40 minutes, 39 seconds West, 145.43 feet to a #898 iron pin found; and thence South 71 degrees, 35 minutes, 52 seconds West, as follows: 140.60 feet to steel post, continue an additional 69.99 feet to a #898 iron pin found, and an additional 37.42 feet to the BEGINNING, containing 9.106 acres, as surveyed with State Plane NAD 83 bearings, November 26, 2018, by Robert G. Barrett, TRLS No. 898. Encumbered by approximately 0.178 acre of county road and utility easement extending 25 feet from center of Cedar Grove Road.

This being the same property conveyed to Rejoice Osaghae Morgan, by virtue of a Warranty Deed dated December 20, 2021, from Cecil Derrick Smtohers and wife, Debra Radford Smothers, as appears of record in Record Book 371, Page 232, in the Register’s Office of Benton County, Tennessee.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights or redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:
The sale held pursuant to the Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
Title to said real estate is believed to be good, however, the undersigned will sell as Trustee and convey only such interest as vested in him by Rejoice O. Morgan, by virtue of the Deed of Trust.
