By the authority granted by a "Default Judgment Against Defendant Brent A. Hall" filed in the above styled case on July 15, 2024 and entered of record in Minute Book 86, Page 438, I, Timothy R. Burrus, Special Commissioner, will on October 25, 2024, at 10:00 A.M., offer for sale to the highest and best bidder, the real property in the matter of Richard A. Hall, etal v. Brent A. Hall, etal, as set out in said "Default Judgment Against Defendant Brent A. Hall".
LOCATION OF SALE: The Real Estate will be sold in the Benton County Chancery Courtroom, 1 Court Square, Camden, Tennessee. A sale sign will be posted at the sight of the property to be sold.

Located in the 5th Civil District of Benton County, Tennessee, and being Tax Map 078C, Group C, Parcel 008.00, in the Assessor’s Office of Benton County, Tennessee, and appearing in Deed Book 378, Page 465, in the Register's Office of Benton County, Tennessee.
TERMS OF SALE:
Said real property will be sold for cash, 10% down on the day of the sale, with the balance due upon confirmation of the sale by the Court. The sale will be held open for ten (10) days (until November 5, 2024, at 12:00 Noon) during which time a person may come into the office of the Clerk and Master at the Benton County Courthouse and raise the highest bid received at the auction by ten percent (10%) and will be required to deposit ten percent (10%) of the raised bid price with the Court. Upon the bid being raised, a second and final auction will be held at the Benton County Courthouse, Chancery Courtroom, 1 Court Square, Camden, Tennessee, on November 5, 2024, at 1:00 P.M. The highest bidder at the second and final auction will be the buyer. Should the bid not be raised, the high bidder from the first sale will be the successful buyer. Possession of the real property will be upon delivery of the deed. The purchaser shall be responsible for all future property taxes from the date of closing forward and shall be prorated at closing.
This property is offered and sold as is, in the present condition, with no warranties or representations, express or implied, not noted herein. While Chancery sales are conclusive upon all parties to the action and generally confer a good title, nevertheless there is no warranty of title. The sale is subject to the confirmation of the Court.

NOTICE OF SALE OF REAL ESTATE
WHEREAS, by Deed of Trust dated December 15, 2022, recorded in the Register's Office of Benton County, Tennessee, in Record Book 387, Page 717 ("Trust Deed"), Timothy L. Lane and Kari L. Lane conveyed to Investors Title Company, Trustee, the real estate therein described, to secure the payment of certain indebtedness therein described; and
WHEREAS, the Trust Deed was modified by a Modification of Deed of Trust dated December 15, 2023 and recorded in Record Book 305, Page 574, in the Register's Office of Benton County, Tennessee; and
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and FirstBank, the lawful holder of the indebtedness, has declared the entire balance due and payable; and
WHEREAS, Adam C. Crider was appointed Successor Trustee by instrument appearing of record in Record Book 417, Page 526 in the Register's Office of Benton County, Tennessee.
NOW, THEREFORE, notice is hereby given that on Wednesday, October 23, 2024 at 10:00 a.m., at the main door of the Courthouse in Camden, Benton County, Tennessee, I will sell to the last, highest and best bidder for cash and in bar of all appraisement, homestead exemption, curtesy and dower rights and equitable and statutory rights of redemption, all of which were expressly waived in the Trust Deed, the following real estate, lying and being in the Second Civil District of Benton County, Tennessee, and more particularly described as follows:
The property described on Deed of Trust of record in Record Book 387, Page 717, in the Register's Office of Benton County, Tennessee.
No opinion is rendered by the Successor Trustee as to the accuracy of the legal description.
The street address of the property is 336 Katelyn Drive, Holladay, Tennessee and the property is shown as a portion of Map 120 Parcel 8.14 in the Benton County Tax Assessor's Office.
Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants or easements, if any, of record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
