TRUSTEE'S NOTICE OF SALE

WHEREAS, Bryan Richardson, by Deed of Trust dated October 12, 2022, and recorded in the Register's Office of Benton County, Tennessee, in Record Book 384, Page 557, conveyed to John W. Whitworth, Trustee, the hereinafter described real estate to secure the payment of a certain installment note and any renewals thereof; and

WHEREAS, default has been made in the payment of the indebtedness and the holder of the note has declared the entire amount due and payable as provided in the Deed of Trust.  The Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof and the public is hereby notified that the undersigned Trustee will sell hereinafter described real estate at public auction to the highest and best bidder, for cash in hand, at the North door of the Courthouse in the Town of Camden, Tennessee, at 10:00 a.m. on Thursday, August 29, 2024.  Said property to be sold in bar of the equity of redemption and subject to the liens of all special assessments against it.

The real estate to be sold is located in Benton County, Tennessee, and more particularly described as follows:

BEING the following described real estate situated in the Second Civil District of Benton County, Tennessee, and being Tract 36 of an unrecorded plat, more particularly described as follows:

BEGINNING at a 1/2-inch rebar with cap set in the west line of Latendresse, Deed Book 62, Page 104, being located North 00 degrees 15 minutes 52 seconds East 699.99 feet from a 18-inch White Oak found at an interior corner of Latendresse; runs thence with a severance line North 76 degrees 46 minutes 48 seconds West, 749.83 feet to a 1/2-inch rebar with cap set in the right-of-way of Kerri Drive, 25 feet from center; thence with the right-of-way of Kerri Drive North 01 degrees 34 minutes 16 seconds East, 225.27 feet to a 1/2-inch rebar with cap set; thence with a severance line South 88 degrees 25 minutes 44 seconds East, 725.80 feet to a 1/2-inch rebar with cap set in the west line of Latendresse; thence with Latendresse South 00 degrees 15 minutes 52 seconds West, 376.77 feet to the Point of Beginning and containing 5.04 acres, more or less, as surveyed by Thomas A. Young, Tennessee License Number 2265, of L. I. Smith & Associates, 302 North Caldwell Street, Paris, TN, on August 11, 2022. Bearings are based upon the Tennessee State Plane Coordinate System, NAD 83.

This property is subject to a 25-foot utility easement reserved along the right of way of Kerri Drive.

This conveyance is subject to the following restrictions for the benefit of and enforcement by Grantors, the owners of adjoining property or owners of property in Ruby Acres Subdivision. Trash: No trash, rubbish, garbage, or other waste material shall be kept or permitted on the property, except in sanitary containers concealed from public view. No junk cars, discarded appliances, tires, etc., shall be allowed to accumulate on the property. Sewage: All dwellings must have its own sewage disposal system approved by the State of Tennessee Department of Health.

This being the same property conveyed to Bryan Richardson, by virtue of a Warranty Deed dated October 12, 2022, from Barry Keith Arnold and wife, Karren Sue Arnold, as appears of record in Record Book 384, Page 553, in the Register’s Office of Benton County, Tennessee.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights or redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.  In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to the Notice may be rescinded at the Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.

Title to said real estate is believed to be good, however, the undersigned will sell as Trustee and convey only such interest as vested in him by Bryan Richardson, by virtue of the Deed of Trust.

KNOW ALL MEN BY THESE PRESENTS:

That, WHEREAS, by Deed of Trust recorded on March 5, 2014, of record in the Register's Office of Benton County, Tennessee, in Record Book 247, page 29, PATRICK D. PELLETT did convey in trust, to W. KENT JONES,  Trustee, a tract of land hereinafter described, to secure the payment of the indebtedness described in said Deed of Trust to CARROLL BANK & TRUST; and,

WHEREAS, said Deed of Trust provides that in the event of default in the payment of the debt secured by said Deed of Trust, when due, or in the event of failure to comply with any of the conditions and/or covenants of said Deed of Trust, the whole amount of the unpaid principal sum, together with all interest due and accrued upon the same, together with all other payments agreed to be made, shall, at the option of the holder, become due and payable immediately without demand or notice thereof;  and,

Other Interested parties:  NONE.  If applicable, the notice requirements of  TCA 35-5-117 have been met.

The debtors' equity of redemption, homestead, dower and all other rights or exemptions of the debtors are waived in said deed of trust, and the title is believed to be good, but said real estate will be sold and conveyed by me as Trustee and not otherwise.

Said sale will be made by Trustee only, without covenants of seizin or warranties of title, and title will be made subject to any unpaid taxes and assessments and all valid restrictions, liens, covenants or easements, if any, of record on said property.
