WHEREAS, Bryan Richardson, by Deed of Trust dated October 12, 2022, and recorded in the Register's Office of Benton County, Tennessee, in Record Book 384, Page 557, conveyed to John W. Whitworth, Trustee, the hereinafter described real estate to secure the payment of a certain installment note and any renewals thereof; and
WHEREAS, default has been made in the payment of the indebtedness and the holder of the note has declared the entire amount due and payable as provided in the Deed of Trust. The Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof and the public is hereby notified that the undersigned Trustee will sell hereinafter described real estate at public auction to the highest and best bidder, for cash in hand, at the North door of the Courthouse in the Town of Camden, Tennessee, at 10:00 a.m. on Thursday, August 29, 2024. Said property to be sold in bar of the equity of redemption and subject to the liens of all special assessments against it.

BEGINNING at a 1/2-inch rebar with cap set in the west line of Latendresse, Deed Book 62, Page 104, being located North 00 degrees 15 minutes 52 seconds East 699.99 feet from a 18-inch White Oak found at an interior corner of Latendresse; runs thence with a severance line North 76 degrees 46 minutes 48 seconds West, 749.83 feet to a 1/2-inch rebar with cap set in the right-of-way of Kerri Drive, 25 feet from center; thence with the right-of-way of Kerri Drive North 01 degrees 34 minutes 16 seconds East, 225.27 feet to a 1/2-inch rebar with cap set; thence with a severance line South 88 degrees 25 minutes 44 seconds East, 725.80 feet to a 1/2-inch rebar with cap set in the west line of Latendresse; thence with Latendresse South 00 degrees 15 minutes 52 seconds West, 376.77 feet to the Point of Beginning and containing 5.04 acres, more or less, as surveyed by Thomas A. Young, Tennessee License Number 2265, of L. I. Smith & Associates, 302 North Caldwell Street, Paris, TN, on August 11, 2022. Bearings are based upon the Tennessee State Plane Coordinate System, NAD 83.
This property is subject to a 25-foot utility easement reserved along the right of way of Kerri Drive.
This conveyance is subject to the following restrictions for the benefit of and enforcement by Grantors, the owners of adjoining property or owners of property in Ruby Acres Subdivision. Trash: No trash, rubbish, garbage, or other waste material shall be kept or permitted on the property, except in sanitary containers concealed from public view. No junk cars, discarded appliances, tires, etc., shall be allowed to accumulate on the property.
